‘Client’ refers to any individual or entity voluntarily engaging our Services.
Description of Services

Deck & Driveway Dazzle provides professional power washing and deck restoration services for residential and commercial properties. Our services include power washing for various surfaces, comprehensive deck restoration, and specialized cleaning for concrete driveways, interlock, and stone. All services are performed by trained professionals using industry-standard equipment and eco-friendly products, subject to the terms outlined in this agreement.
Power Washing Services
We offer power washing for a range of surfaces, including but not limited to:

Concrete Driveways: Removal of dirt, grime, oil stains, and other contaminants from concrete surfaces.

Interlock and Stone: Cleaning of interlocking pavers, stone patios, walkways to restore their appearance.
Power washing services are designed to remove dirt, mold, mildew, and other debris. Results may vary depending on surface condition, age, or environmental factors. A written quote will be provided, detailing the scope, price, and estimated timeline for each project.
Deck Restoration Services
Our comprehensive deck restoration process includes the following steps, as needed:

Pro Soft Washing: Initial cleaning to remove dirt, mildew, and old finishes.

Sanding: Surface preparation to smooth rough areas and ensure proper stain adhesion.

Limitations and Exclusions

Services are limited to the scope agreed upon in the written quote. Additional work (e.g., repairs to damaged deck boards, cleaning of adjacent surfaces) will incur extra charges, subject to client approval.

We are not responsible for pre-existing damage, such as cracked concrete, loose interlock, or rotted wood, unless explicitly included in the quote.

Certain stains, marks, or discolorations may not be fully removable due to surface type or condition.

Deck staining and sealing results depend on proper maintenance by the client, as outlined in our care instructions.
Environmental and Safety Considerations

All power washing and chemical washing services comply with local environmental regulations, including proper water runoff management and disposal of cleaning solutions.

Services may be rescheduled due to adverse weather conditions (e.g., rain, high winds) to ensure safety and quality.

Quote and Agreement
All services are subject to an official written quote, which outlines the scope, pricing, and estimated completion time. The quote is valid for 30 days from issuance. Any changes to the scope must be agreed upon in writing and may affect the price or timeline.
All Services are provided based on a mutually agreed quote.

Client Responsibilities
Overview
Clients engaging Deck & Driveway Dazzle for power washing and deck restoration services are responsible for fulfilling certain obligations to ensure safe, efficient, and high-quality service delivery. By booking our services, clients agree to comply with the responsibilities outlined below.
Property Access and Preparation

Access: Clients must provide clear and safe access to the work area (e.g., decks, driveways, interlock, stone surfaces) on the scheduled service date. This includes unlocking gates, clearing vehicles, and removing obstacles such as furniture, planters, or decorations.

Surface Preparation: For deck restoration, clients must ensure the deck is free of items like grills, rugs, or toys. For power washing concrete, interlock, or stone, clients must remove loose debris (e.g., leaves, gravel) where possible.

Utilities: Clients must provide access to a working water source (e.g., outdoor spigot) and, if required, electrical outlets for equipment. Clients are responsible for ensuring sprinklers or irrigation systems are turned off during service.
Disclosure of Surface Conditions

Clients must inform Deck & Driveway Dazzle of any known issues or damage to surfaces prior to service, including but not limited to:

Cracked or unstable concrete driveways.
-
Loose or damaged interlock pavers or stone.
-
Rotted, splintered, or loose deck boards, railings, or other wooden structures.
-
Pre-existing stains, paint peeling, or other surface irregularities.
Failure to disclose such conditions may result in additional charges, service delays, or exclusion from liability for damage related to these issues.

Safety Compliance

Pets and People: Clients must secure pets and ensure children or other individuals remain clear of the work area during service to prevent accidents or interference with equipment (e.g., pressure washers, sanders).

Hazards: Clients must notify Deck & Driveway Dazzle of any safety hazards, such as uneven surfaces, exposed nails, or electrical wiring near the work area.

Instructions: Clients must follow any safety instructions provided by our team, such as closing windows or doors to prevent water intrusion during power washing.
Property Protection

Clients are responsible for securing or removing valuables, fragile items, or personal belongings near the work area (e.g., outdoor electronics, potted plants, or decorations).

For deck restoration, clients must ensure that adjacent surfaces (e.g., siding, glass) are protected or inform us if additional precautions are needed to avoid staining or chemical overspray.

Deck & Driveway Dazzle is NOT liable for damage to items or surfaces not properly secured or disclosed by the client.
Communication and Cooperation

Clients must provide accurate contact information and respond promptly to communications regarding scheduling, quotes, or service updates.

Clients must notify Deck & Driveway Dazzle of any changes to the scope of work (e.g., additional surfaces to clean) at least 48 hours before the service date.

For deck restoration, clients must confirm their choice of stain color or sealant type when prompted. After confirmation, any changes can incur additional charges.
Post-Service Care

For deck restoration, clients must follow our provided care instructions to maintain the stain and sealant (e.g., avoiding heavy foot traffic for at least 72 Hours, not cleaning with harsh chemicals, and more outlines in our Post-care instructions). Failure to follow these instructions may void any satisfaction guarantees or warranties.

Clients must report any concerns about the service (e.g., missed areas, dissatisfaction) within 48 hours of completion to allow for timely resolution.
Compliance with Terms

Clients must adhere to the payment terms, cancellation policies, and other conditions outlined in these Terms and Conditions.

Failure to meet these responsibilities may result in service delays, additional fees, or termination of services, as outlined in the “Termination of Services” section.
Pricing and Payment Terms
Overview
Deck & Driveway Dazzle provides transparent pricing for all power washing and deck restoration services. By engaging our services, clients agree to the pricing and payment terms outlined below, which ensure timely service delivery and the procurement of necessary materials.
Free Quote

All clients receive a free, no-obligation quote for services, including power washing (e.g., concrete driveways, interlock, stone) and deck restoration (e.g., power washing, sanding, chemical washing, staining, sealing).

The quote will detail the scope of work, estimated timeline, and total cost, and is valid for 30 days from issuance.
-
Acceptance of the quote constitutes agreement to these Terms and Conditions and initiates the service booking process.
Deposit Requirement (Deck / Fence Restoration)

Upon acceptance of the quote, clients must pay a non-refundable 50% deposit to cover the cost of materials (e.g., stains, sealants, cleaning solutions) and preparation for the service.

The 50% deposit is due immediately upon quote acceptance and must be paid in full at least two (2) days prior to the first scheduled service date.

Failure to pay the 50% deposit at least two (2) days before the first service date will result in cancellation of the service.
Deposit Requirement (Power washing services)

Upon acceptance of the quote, clients must pay a non-refundable 50% deposit to successfully book the quote and allow preparation for the service.

The 50% deposit is due immediately upon quote acceptance and must be paid in full at least two (2) days prior to the scheduled service date.

Failure to pay the 50% deposit at least two (2) days before the service date will result in cancellation of the service.
Final Payment

The remaining 50% balance is due immediately upon completion of the last day of service, once the client has inspected and approved the work.

Payment for the final balance must be made on the same day the service is completed, unless otherwise agreed in writing by Deck & Driveway Dazzle.
Payment Methods

Payments can be made via cash, bank transfer or check

All payments must be made in Canadian Dollars (CAD)
Late Payments
-
Failure to pay the final 50% balance on the day of service completion will incur in the immediate removal of all materials used and applied during the service.

Deck & Driveway Dazzle reserves the right to pursue legal action and/or engage a collection agency for unpaid balances, with clients responsible for any associated costs.
Additional Charges

Any work outside the agreed scope of the quote (e.g., cleaning additional surfaces, repairing damaged deck boards) will incur additional charges, subject to client approval and a revised quote.

Clients will be notified of any potential additional costs before work is performed.
Refunds and Disputes

The 50% deposit is non-refundable, as it covers materials and preparation costs.

No refunds will be issued for completed services unless Deck & Driveway Dazzle fails to meet the agreed scope of work, as determined through the dispute resolution process outlined in the Dispute Resolution section or “Pricing & Refund” page.

Clients must report any payment or service concerns within 48 hours of service completion for review.
Cancellations & Rescheduling
Overview
Deck & Driveway Dazzle understands that scheduling changes may occur. This section outlines the policies for cancelling or rescheduling power washing and deck restoration services to ensure efficient operations and fairness to all clients.
Client Cancellations

Clients may cancel services by providing written notice (e.g., email to deckanddrivewaydazzle@gmail.com) at least 48 hours prior to the scheduled service date.

If the 50% deposit has been paid, and it is more than 48 hours until the scheduled service date. 100% of the deposit can be refunded to the same payment method used and the client will not incur a cancellation or any extra fees.

If the 50% deposit has been paid, and it is less than 48 hours until the scheduled service date. The deposit it is non-refundable due to costs incurred for materials (e.g., chemicals, sealants) and preparation, as outlined in the “Pricing and Payment Terms” section.

Failure to pay the 50% deposit at least two (2) days prior to the service date will result in automatic cancellation of the service. Clients will be notified of the cancellation, and rebooking is subject to availability and a new quote.
Client Rescheduling

Clients may reschedule services by providing written notice (e.g., email to deckanddrivewaydazzle@gmail.com) at least 48 hours prior to the scheduled service date, subject to availability.

There is no rescheduling fee.

The 50% deposit will be applied to the rescheduled service, provided the new date is within 45 days of the original date. Otherwise, a new quote will be required and the 50% deposit will become non-refundable and non-applicable to the new quote.
Company-Initiated Cancellations or Rescheduling

Deck & Driveway Dazzle reserves the right to cancel or reschedule services due to unforeseen circumstances, such as adverse weather (e.g., rain, high winds), equipment failure, or crew unavailability.

Clients will be notified as soon as possible and offered a rescheduled date at no additional cost. If rescheduling is not feasible, the 50% deposit will be refunded in full.
Weather Considerations

Power washing and deck restoration services are weather-dependent. Deck & Driveway Dazzle may reschedule services if weather conditions (e.g., rain, extreme heat) pose safety risks or affect product quality (e.g., staining in moist conditions). Clients will be informed promptly, and no fees will apply.
Liability, Warranties & Insurance
Overview
Deck & Driveway Dazzle is committed to delivering high-quality deck restoration services and power washing. This section outlines our liability limits and any warranties provided to clients.
Limitation of Liability

Deck & Driveway Dazzle is not liable for pre-existing damage to surfaces, including but not limited to cracked concrete, loose interlock, damaged stone, or rotted deck boards, unless explicitly noted in the quote and addressed in the service scope.

We are not responsible for damage caused by client negligence, such as failure to disclose surface issues, secure valuables, or provide clear access, as outlined in the “Client Responsibilities” section.

Power washing may not remove all stains (e.g., deep oil stains on concrete, permanent discoloration) due to surface conditions. Deck & Driveway Dazzle is not liable for incomplete stain removal unless we fail to follow industry-standard methods.

For deck restoration, results (e.g., stain color, sealant durability) may vary based on wood type, age, or prior treatments. We are not liable for variations beyond our control.
Warranties

Satisfaction Guarantee: We offer a satisfaction guarantee for deck restoration services. If clients are dissatisfied with the results, we will address concerns (e.g., reapply stain in missed areas) at no additional cost, provided the issue is reported within 3 days of the service completion and the deck has been maintained per our care instructions. This does not include a change in the color of stain, as this will be set and agreed upon before application. Any changes in color will incur new fees and subject to a new quote.

Service completion is the day our team will visit the last time, 72 Hours after applying the seal / stain.

Workmanship Warranty: Deck restoration services (sanding, staining, sealing) are warranted against defects in workmanship for 30 days from completion. This does not cover damage due to improper maintenance, extreme weather, or client modifications.

Warranties are void if clients attempt repairs, use harsh chemicals, or fail to follow our post-service care instructions (e.g., avoiding heavy traffic on newly stained decks for 72 Hours).

Power washing services (e.g., concrete, interlock, stone) are not warranted due to variable surface conditions but are performed to industry standards.
Insurance

Deck & Driveway Dazzle carries general liability insurance to cover accidental damage caused by our team during service. Claims for such damage must be reported within 24 hours of service completion.
Safety & Compliance

Deck & Driveway Dazzle prioritizes safety and compliance with industry standards and local regulations during power washing and deck restoration services. Clients are expected to support these efforts.
Safety Standards

Regulatory Compliance

Client Cooperation

Initial Contact

We will investigate and attempt to resolve the issue within 2 - 3 business days.
Mediation

If the issue cannot be resolved directly, both parties agree to pursue mediation as the preferred method before escalating to legal action.

Mediation will be conducted by a neutral third party in Barrie, Ontario, with costs shared equally.
Governing Law

All disputes are governed by the laws of Ontario.

Legal proceedings, if necessary, will be conducted in Simcoe County, Ontario.
Limitation

Claims that may come up after the initial 72 Hours and our team could not resolve must be raised within 30 days of service completion. Deck & Driveway Dazzle is not liable for claims based on stain, paint, oil, or color changes, as outlined in the Warranties > Satisfaction Guarantee, section.

Deck & Driveway Dazzle is not liable for any claims raised after this 30 day period.
Termination of Services
Overview
Deck & Driveway Dazzle reserves the right to terminate services under specific circumstances to ensure safe and fair operations.
Grounds for Termination

Clients fail to pay the 50% deposit at least two (2) days prior to the service date, as outlined in the “Pricing and Payment Terms” section.

Clients fail to comply with responsibilities (e.g., providing access, securing pets) outlined in the “Client Responsibilities” section, creating unsafe or unworkable conditions.

Clients exhibit any type of abusive or threatening behavior towards any member of our team.

Unsafe conditions (e.g., structural hazards, severe weather) are identified during service.

Consequences

Upon termination, clients remain liable for payment of any completed work or incurred costs (e.g., materials purchased).

The 50% deposit is non-refundable, as it covers preparation and materials.

Deck & Driveway Dazzle will notify clients of termination in writing, with reasons provided.
Client Termination

Clients may terminate services before work begins, subject to the cancellation policies in the “Cancellations and Rescheduling” section.
Force Majeure
Overview
Deck & Driveway Dazzle is not liable for delays or failure to perform services due to events beyond our control.
Covered Events

We are excused from performing power washing or deck restoration services due to force majeure events, including but not limited to:

Severe weather (e.g., storms, flooding, extreme heat).

Government restrictions (e.g., water usage bans, emergency orders).

Affected services will be rescheduled at no additional cost to the client, subject to availability.

If rescheduling is not feasible, the 50% deposit may be refunded, assessed on a case by case basis.
